Welcome to Navimental! These Terms & Conditions ("Terms") govern your use of our website at https://navimental.com ("Website") and any peer support services provided by Navimental, Inc. ("Navimental," "we," "our," or "us").

Please read these Terms carefully. By accessing our Website or Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. About Navimental’s Services

• Navimental provides peer support from Family Peer Support Specialists and other certified peers or Family Support Navigators.
• Our Services are intended to offer emotional support, guidance, and skills-building based on lived experience.

We do not:

• Provide medical care, diagnosis, or treatment.
• Offer crisis intervention services.
• Accept or bill insurance (all services are self-pay).

If you or someone you know is experiencing a crisis, call or text 988, or visit your nearest emergency room.

2. Eligibility

You may use Navimental if:

• You are at least 18 years old, or under 18 with verified parental or guardian consent.
• You are located within the United States.
• You agree to comply with these Terms and applicable laws.

We may suspend or terminate access for violations at our sole discretion.

3. Accounts

When creating an account, you agree to:

• Provide accurate, current information.
• Maintain the security of your login credentials.
• Notify us immediately of any unauthorized use of your account.

You are responsible for any activity that occurs under your account.

4. Payments and Fees

All Services are self-pay. You agree to pay all fees for booked services at the time of purchase. Navimental does not accept insurance, Medicaid, or Medicare. Payments are processed through a third-party vendor.

Cancellation policies:

• Cancel at least 24 hours before your session to avoid charges.
• No-shows or late cancellations may be charged in full.

Refunds are generally not provided unless required by law.

5. Proper Use of Services

You agree not to:

• Violate any laws or third-party rights.
• Harass, harm, or exploit others.
• Upload harmful content, malware, or spam.
• Attempt to scrape, hack, or disrupt our systems.
• Misrepresent yourself or impersonate others.

We may investigate and take legal action for violations.

6. Intellectual Property

Navimental owns all content on our Website and Services, including text, graphics, branding, and software. You may not copy, modify, distribute, or create derivative works without our written consent.

You retain rights to any content you submit but grant Navimental a license to use it solely to operate and improve our Services.

7. Communications and Messaging Consent

By using our Services, you consent to receive:

• Emails related to your account, sessions, and important updates.
• SMS/text messages for confirmations and reminders (message and data rates may apply).

You can opt out of marketing messages but cannot opt out of essential communications (like appointment reminders).

8. Disclaimer of Warranties

Navimental provides Services "as is" and "as available." We do not guarantee that:

• Services will meet your expectations.
• Services will be uninterrupted or error-free.
• Any advice or information provided is a substitute for professional healthcare or legal advice.

Use Navimental at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, Navimental and its team are not liable for:

• Any indirect, incidental, or consequential damages.
• Lost profits, lost data, or loss of goodwill.
• Any amount greater than the fees paid by you to Navimental in the past twelve (12) months.

Some states may not allow limitations of liability, so some of these limits may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Navimental, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from:

• Your use of our Services.
• Your violation of these Terms or any applicable laws.
• Your infringement of any third-party rights.

11. Dispute Resolution and Arbitration

If a dispute arises between you and Navimental:

• You agree to first try to resolve it informally by contacting us at mike@navimental.com.
• If unresolved, disputes will be resolved through binding arbitration in Maine, not in court.
• Arbitration will be conducted by a single neutral arbitrator through the American Arbitration Association (AAA).
• You waive your right to a jury trial and to participate in a class action.

This agreement to arbitrate survives even after you stop using Navimental.

12. Force Majeure

We are not responsible for any delays or failures due to causes beyond our control, including natural disasters, internet outages, legal restrictions, or pandemics.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post them on our Website and update the Effective Date. Your continued use after changes means you accept the updated Terms.
